Terms & Conditions

1. DEFINITIONS AND INTERPRETATION
   • ‘Event’ means an entertainment event including, without limitation, a concert, exhibition, tour, theatrical and/or music event in respect of which We have the right to sell You Tickets.
   • ‘LW Theatres’ (and ‘We’, ‘Our’, ‘Ours’ and ‘Us’) refers to LW Theatres Group Limited, a company registered in England and Wales whose company registration number is 03987955, whose registered VAT number is 238 6896 08 and whose registered office is at 65 Drury Lane, London WC2B 5SP, who is the Trader for the purposes of The Consumer Rights Act 2015.
   • ‘Site’ means lwtheatres.co.uk.
   • ‘Terms and Conditions’ means these terms and conditions.
   • ‘Tickets’ means printed, electronic or other type of evidence of the right to occupy space at or to attend an Event sold by Us to You.
   • ‘Venue’ means an LW Theatre, comprising of Adelphi Theatre (co-owned with the Nederlander Group), Cambridge Theatre, Gillian Lynne Theatre, His Majesty’s Theatre, The London Palladium and Theatre Royal Drury Lane.
   • ‘Voucher(s)’ means an LW Theatres Gift Voucher You purchase from Us and includes both physical and e-vouchers.
   • ‘You’ means you as the purchaser of a Voucher or anybody who in Our reasonable opinion is acting with your authority or permission. ‘Your’ shall be read accordingly.
   • ‘Recipient’ is the person to whom the Voucher has been given by ‘You’.
2. GENERAL
   • These Terms and Conditions shall be applicable to all Vouchers and unless set out in these terms, or the context otherwise requires, all references in these Terms and Conditions are to Gift Vouchers Terms and Conditions.
   • Purchase and/or use of a Voucher will constitute acceptance of these Terms and Conditions. Please read these Terms and Conditions carefully before using and/or purchasing your Voucher.
   • These Terms and Conditions constitute the entire agreement and understanding between Us and You with respect to Your use of Vouchers.
   • If any provision of these Terms and Conditions is unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from these Terms and Conditions and shall not affect the validity and enforceability of any remaining provisions.
   • Any failure or delay by Us in enforcing (in whole or in part) any provision of these Terms and Conditions will not be interpreted as a waiver of our rights or remedies.
3. PURCHASING YOUR VOUCHER 
   • Gift Vouchers can be purchased online via our website (lwtheatres.co.uk).
   • Our acceptance of your order for any Gift Voucher will take place when we email you to confirm your order.
   • You may choose to receive the Gift Voucher in the form of a physical printed Voucher or as an online e-Voucher.
   • Physical Vouchers shall be dispatched by post to the designated address by Our third-party printing and fulfilment company.
   • E-Vouchers shall be dispatched by email to the designated email account by Us.
   • It is your responsibility to ensure that you provide the correct email or postal address. We will not be responsible for the incorrect delivery of Vouchers due to an error by you (such as a mistyped address).
   • Cleared payment is required prior to the dispatch of orders. Payment is taken automatically at the time of purchase. We reserve the right to decline any order without providing explanation.
   • Vouchers are only available for purchase in pounds sterling.
   • We will not be responsible for any Vouchers that cannot be delivered due to the recipient’s spam filters, firewalls, capacity of the mailbox, or any other factors outside of Our reasonable control.
   • The purchaser of the Voucher has the right to cancel the Voucher within 14 days of receipt provided that the Voucher has not been used. If You exercise your right to cancel, We will endeavour to refund the amount of the Voucher to the original payment method used during ordering within 14 days of cancellation.
   • The purchaser of the Voucher must inform Us of their intention to cancel the purchase within 14 days of the date on which the Voucher is received. This should be done by emailing Us at customer.relations@lwtheatres.co.uk. Please include a clear statement of the wish to cancel the purchase, provide evidence of proof of purchase, details of name, phone number, email address, address and details of the order to cancel.

4. USING YOUR VOUCHER
   • A Gift Voucher contains the monetary value which was paid for that Gift Voucher at the point of purchase. It is not a credit card, charge card, cheque guarantee card or debit card, and the balance on a Gift Voucher will not earn any interest.
   • The monetary value of a Gift Voucher can only be redeemed for Tickets available to purchase online on Our Site, including tours and hospitality. Gift Vouchers can be used as full or part payment for Tickets. If the monetary value of a Gift Voucher is not used in any transaction in full, the remaining balance will still be valid until the stated expiry date.
   • You can check the balance of any funds remaining on a Gift Voucher by emailing Us at customer.relations@lwtheatres.co.uk.
   • We reserve the right to refuse to accept damaged Vouchers or any Voucher which we believe has been stolen, duplicated, tampered with or is being used fraudulently or is otherwise suspected to be affected by fraud.
   • One or more Vouchers can be redeemed against a single order.
   • You may not exchange or redeem your Voucher for cash.

5. EXPIRATION AND CANCELLATION
   • Your Voucher and the balance on it will expire after 12 months (365 days) from the date of purchase. Once expired, any unused balance will not be refunded.
   • We reserve the right to cancel Your Voucher if we reasonably suspect it has been stolen, is being used fraudulently or in breach of these Terms and Conditions.
   • Except as stated in clause 3 above Vouchers are non-refundable.

6. LOSS, THEFT, DAMAGE
   • You should take care of Your Voucher and treat it like cash. We will not be responsible for Vouchers which are lost, stolen, damaged, destroyed or used without permission.

7. RESALE/USE IN PROMOTIONS
   • The re-sale of Vouchers is strictly prohibited; You may not sell Your Voucher.
   • You may only use Your Voucher for Your own personal non-commercial use. Vouchers may not be used in sales or promotional activities including as giveaways or prizes in competitions without our prior written consent.
   • We reserve the right to cancel any Vouchers that we suspect have been resold or obtained in connection with an unauthorised sales or promotional activity.

8. DATA PROTECTION AND PRIVACY
   • You may be asked to provide certain personal information, including Your or the Recipient’s name, address and contact details. You agree that the information you provide to us will be true, accurate, current and complete in all respects. You also agree to notify us of any changes in this information.
   • When purchasing a physical Voucher, you agree that certain personal information, including Your or the Recipient’s name, address and contact details may be passed on and processed by Our third-party printing and fulfilment company.
   • We are committed to maintaining the security of your personal information in accordance with the requirements of the Data Protection Act 2018.
   • All personal information you provide to us will be controlled and processed in accordance with Our Privacy Policy.

9. LIABILITY OF LW THEATRES
   • We shall not be liable for any loss or damage arising from or in connection with Your use of a Voucher where such loss or damage arises from any cause beyond Our reasonable control. If We fail to comply with these Terms and Conditions for a reason within our reasonable control, We are responsible for loss or damage You suffer that is a foreseeable result of our breach or Our negligence, but We are not responsible for any loss or damage that is not foreseeable. Loss or damage is foreseeable if it is an obvious consequence of Our breach or if it was contemplated by You and Us at the time we entered into these Terms and Conditions. Where any loss or damage arises from a cause within Our control, Our liability to you shall not exceed a sum equal to the balance on Your Voucher as at the date that such loss or damage occurs. This clause shall not exclude or limit any liability that cannot be excluded or limited by law.

10. TERMINATION / VARIATION
    • We reserve the right to amend or waive any provision of these Terms and Conditions from time to time or to terminate the Voucher service on reasonable notice.
    • The Terms and Conditions applicable to the use of a Voucher shall at any time be the terms and conditions published on the Site and your continued use of a Voucher shall constitute your acceptance of such terms and conditions.

11. GOVERNING LAW
    • These Terms and Conditions shall be governed by and construed in all respects in accordance with English law and the parties agree to submit to the exclusive jurisdiction of the English courts.

£250 Gift Voucher Draw

1. Operator: The operator of this prize draw (“Draw”) is LW Theatres Group Limited of 65 Drury Lane, London WC2B 5SP (“LWT”).
2. Eligibility: This Draw is open to all UK residents aged 18 years or over. Employees of LWT, its affiliates, subsidiaries, advertising and promotion agencies, and suppliers, (collectively the “Employees”), and immediate family members and/or those living in the same household as Employees are not eligible to participate in the Draw. The Draw is subject to all applicable laws and regulations.
3. Agreement to Terms: By participating, the contestant (the “Contestant”, “You”) agree to be fully and unconditionally bound by these terms and conditions, and You represent and warrant that You meet the eligibility requirements set out in paragraph 2 above. In addition, You agree to accept the decisions of LWT as final and binding in relation to this Draw.
4. Draw Period: All entries must be submitted by 1 November 2024. Entries received after this time will not be considered.

5. How to Enter: The Draw is free to enter, and no purchase is necessary. The entry must fulfil all field requirements, as specified, to be eligible to win a prize. Entries that are incomplete or do not adhere to the rules or specifications may be disqualified at the sole discretion of LWT. You must provide the information requested. You may not enter more times than indicated by using multiple email addresses, identities, or devices in an attempt to circumvent the rules. If you use fraudulent methods or otherwise attempt to circumvent the rules, your submission may be disqualified at the sole discretion of LWT.
6. Prizes: There will be 1 winner announced on 4 November 2024. No exchanges are available. The specifics of each prize shall be solely determined by LWT (including the choice of performance and the date of the performance, although LWT will use reasonable endeavours to take account of the winner’s preferences if supplied).

The prize is non-transferable.

No cash or other prize substitution shall be permitted except at LWT’s discretion. Any and all prize-related expenses (including but not limited to food and drink or travel and accommodation) shall be the sole responsibility of winner. No substitution of prize or transfer/assignment of prize to others or request for the cash equivalent by winner is permitted. Where the winner’s companion is aged under 18 years old, the companion must have prior parental or guardian permission to accompany the winner when taking up the prize. It is the responsibility of the winner to inform LWT of any wheelchair or other access requirements for the winner and/or their companion when taking up the prize. Recommended age is 7+. Anyone under the age of 4 years of age will not be admitted, under any circumstance. Everyone entering the theatre will require a ticket.

7. Winner Selection and Notification: The winners will be selected by a random drawing using a computer-generated random selection process under the supervision of LWT. The winners will be notified by email using the details provided via the online subscription or purchase of tickets within seven (7) days of selection of the winners. LWT shall have no liability for the winner’s failure to receive notices due to spam, junk e-mail or other security settings or for winner’s provision of incorrect or otherwise non-functioning contact information. The winner must claim its prize offer within seven (7) days from the date of LWT’s initial notification. Receipt by the winner of the prize offer in this Draw is conditional upon compliance with these terms and conditions.

All reasonable effort will be made to contact the winners; however, if the winner cannot be contacted, is ineligible or fails to claim the prize within the seven (7) days, the prize may be forfeited, and a re-draw will take place and an alternative winner will be selected. Following notification, LWT will correspond with the winners to agree the date and performance for which the tickets will be supplied (although the final decision will be at LWT’s sole discretion). The tickets will be sent to each winner via email. Receipt by the winner of the prize offered in this Draw is conditional upon compliance with applicable laws and regulations.

ANY BREACH OF THESE TERMS AND CONDITIONS BY A WINNER (AT LWT’S SOLE DISCRETION) WILL RESULT IN WINNER’S DISQUALIFICATION AS WINNER OF THE DRAW, AND ALL PRIVILEGES AS WINNER WILL BE IMMEDIATELY TERMINATED.

8. Cancellation: LWT reserves the right, in its sole discretion, to cancel, terminate, modify or suspend the Draw should virus, bug, non-authorised human intervention, fraud, or other cause beyond LWT’s control corrupt or affect the administration, security, fairness, or proper conduct of the Draw. In such case, LWT may select a winner from all eligible entries received prior to and/or after (if appropriate) the action taken by LWT. LWT reserves the right, in its sole discretion, to disqualify any individual who tampers or attempts to tamper with the entry process or the operation of the Draw or website or breaches these terms and conditions.

LWT has the right, in its sole discretion, to maintain the integrity of the Draw, to void any Contestant’s entry form where it has reason to believe the Contestant has breached these terms and conditions, including, but not limited to: multiple entries from the same user from different IP addresses; multiple entries from the same computer in excess of that allowed by Draw rules; or the use of bots, macros, scripts, or other technical means for entering. Any attempt by an entrant to deliberately damage any website or undermine the legitimate operation of the Draw may be a breach of applicable law. Should such attempt be made, LWT reserves the right to seek damages to the fullest extent permitted by law.

9. Limitation of Liability: By entering, You agree to release and hold harmless LWT and its subsidiaries, affiliates, advertising and promotion agencies, partners, representatives, agents, successors, assigns, employees, officers, and directors from any liability, loss, litigation, claim, or damage that may occur, directly or indirectly, whether caused by negligence or not, from such entrant’s participation in the Draw and/or his/her acceptance, possession, use, or misuse of any prize or any portion thereof, save to the extent that such exclusion is not permitted by law. LWT, its subsidiaries, affiliates, advertising and promotion agencies, partners, representatives, agents, successors, assigns, employees, officers, and directors shall not be liable for (i) technical failures of any kind, including but not limited to the malfunction of any computer, cable, network, hardware, or software, or other mechanical equipment; (ii) the unavailability or inaccessibility of any transmissions, telephone, or Internet service; (iii) unauthorized human intervention in any part of the entry process or the Draw; or (iv) electronic or human error in the administration of the Draw or the processing of entries, save to the extent that such exclusion is not permitted by law.
10. Disputes: This Draw is governed by the laws of England & Wales. As a condition to participating in this Draw, Contestant agrees that any and all disputes that cannot be resolved between the parties and causes of action arising out of or connected with this Draw, shall be resolved individually, without resort to any form of class action, exclusively before a court in England. Further, in any such dispute, under no circumstances shall LWT be liable for nor shall Contestant be permitted to obtain awards for, and hereby waives all rights to, punitive, indirect, economic, incidental, or consequential damages, including reasonable legal costs, other than Contestant’s actual out-of-pocket expenses (i.e. costs associated with entering this Draw).
11. Privacy Policy: Information submitted with an entry is subject to the Privacy Policy stated on our website.
12. LWT must either publish or make available information that indicates that a valid award took place. To comply with this obligation LWT will send the surname and county of the winner and, if applicable copies of their winning entries, to anyone who writes to the address set out in paragraph 1 (enclosing a self-addressed envelope) within one month after the closing date of the competition. If you object to any or all of your surname, county and winning entry being published or made available, please contact LWT here: customer.relations@lwtheatres.co.uk . In such circumstances, LWT must still provide the information and winning entry to the Advertising Standards Authority on request.
